Mattresses

Congratulations on your purchase of a Purple mattress. Purple is committed to providing superior product durability and quality so that you may achieve a healthful, comfortable rest. Purple does not expect you to experience any defect, but if you do, it is covered under the terms of this limited warranty. This limited warranty applies for ten (10) years from the original date of purchase or until transfer to another consumer (whichever is shorter), for all Purple mattresses sold new in the USA by Purple or a Purple-authorized retailer. This limited warranty warrants against defects due to faulty workmanship or materials as described herein. If defective, Purple will either replace or repair the Purple mattress, and for any valid limited warranty claims made after 30 days from the original date of purchase, any transportation costs associated with repairs or replacements are purchaser’s responsibility. (In no event, however, will the transportation costs exceed Purple's then- standard freight charges). Approved warranties are eligible for upgrading to a more luxurious model or a larger size, provided that purchaser pays the difference between their current purchased model and the upgraded mattress model, in addition to any transportation costs associated with the exchange/upgrade. Notwithstanding Purple's commitment to service defects, such service may be conducted by third parties authorized by Purple, such as retailers. This warranty applies to the original purchaser only and is expressly limited as described herein.

EXPRESS LIMITATIONS

(1) ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, FITNESS FOR A PARTICULAR PURPOSE AND MERCHANTABILITY ARE EXPRESSLY LIMITED TO THE DURATION OF THIS WRITTEN WARRANTY;
(2) PURPLE SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF ANY BREACH OF THIS WARRANTY OR RESULTING FROM THE USE OF ANY MATTRESS, COVER, FOUNDATION, FRAME, PILLOW, TOP-OF-BED PRODUCT (SUCH AS COMFORTERS, SHEETS, MATTRESS PROTECTORS OR BLANKETS) OR ACCESSORY. REPLACEMENT OR REPAIR AS SET FORTH HEREIN SHALL BE THE EXCLUSIVE REMEDY FOR BREACH OF THIS WARRANTY;
(3) THIS WARRANTY APPLIES TO THE MATTRESS AND NOT TO ANY ACCESSORIES OR OTHER PRODUCTS ASSOCIATED WITH THE MATTRESS.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.

THE WARRANTY IS VOID IF

(1) THE MATTRESS IS NOT USED FOR NORMAL IN-HOME, CONSUMER USE; 
(2) THE MATTRESS IS RESOLD OR DONATED BY THE ORIGINAL PURCHASER; 
(3) THE PRODUCT IS USED OUTSIDE THE USA (there may be a separate warranty for non-U.S. products, but be advised that it may not be from Purple); 
(4) THE MATTRESS IS USED BY A MEDICAL PATIENT; 
(5) IF THE MATTRESS IS NOT USED ON FIRM, SOLID-SURFACE, NON-SPRING FOUNDATION OR ADJUSTABLE BED BASE THAT IS STRUCTURALLY CAPABLE OF SUPPORTING THE WEIGHT OF PURCHASER’S PURPLE MATTRESS AND USER(S) FROM THE DATE OF DELIVERY ONWARD TO THE DATE OF THE WARRANTY CLAIM WITHOUT INTERRUPTION. THIS LIMITED WARRANTY AND OTHER PERFORMANCE WARRANTIES ARE BASED ON TESTS CONDUCTED ON “SETS” THAT CONSIST OF OUR MATTRESSES AND OUR FOUNDATIONS/ADJUSTABLE BED BASES. IF YOU AS PURCHASER USE INAPPROPRIATE FOUNDATIONS, BOX SPRINGS, ADJUSTABLE BED BASES, OR BED FRAMES WITH THE MATTRESS (FOR DETAILS PLEASE REFER TO SUBSECTION 1 BELOW), SUCH USE WILL VOID THIS LIMITED WARRANTY.
PURPLE MAY REQUIRE A PURCHASER TO PROVIDE PROOF OF THE QUALITY OF THE FOUNDATION, ADJUSTABLE BED BASE, OR BED FRAME USED IN CONJUNCTION WITH THE MATTRESS IF PURCHASER MAKES A CLAIM UNDER THIS LIMITED WARRANTY. PURPLE MAKES NO REPRESENTATIONS WHATSOEVER AS TO THE REQUIRED STRUCTURAL INTEGRITY OR RATED LOAD FOR ANY FRAME, FOUNDATION, OR ADJUSTABLE BASE NOT MANUFACTURED BY OR FOR PURPLE. PURPLE RESERVES THE RIGHT TO INVALIDATE THIS LIMITED WARRANTY IF THE FOUNDATION IS DETERMINED, IN PURPLE’S REASONABLE DISCRETION, TO BE INADEQUATE OR IF THE MATTRESS IS FOUND TO BE IN AN UNSANITARY CONDITION.
(6) THE MATTRESS IS NOT USED BUT RATHER IS STORED (WHETHER LONG OR SHORT TERM) IN ANY ORIENTATION; 
(7) IF PURPLE DETERMINES IN ITS REASONABLE DISCRETION THAT THE MATTRESS HAS BEEN DAMAGED, ABUSED, OR NEGLECTED; 
(8) IF THERE ARE LIENS OR ENCUMBRANCES AGAINST THE MATTRESS; 
(9) IF THE WARRANTY PROCESS BELOW, AND AS COMMUNICATED THROUGH EMAIL DURING THE WARRANTY PROCESS, IS NOT FOLLOWED 

Purple will not charge purchaser to repair or replace purchaser’s mattress if it is reasonably deemed by Purple to be defective according to the terms herein during the first ten (10) years since the original purchase; however, for any warranty claim made after thirty (30) days of the original date of purchase, the purchaser is required to pay all transportation costs associated with repairs or replacements. The warranty for any repaired or replaced mattress runs from the date of original purchase and not from the date of the replacement. Whether to repair or to replace the mattress shall be at Purple’s sole option. If your mattress model is no longer available, your mattress may be replaced with an equivalent model. The cover is not part of the 10-year warranty and is separately addressed herein. 

For the health and safety of those required to dispose of, or otherwise handle, the mattress, Purple or agents may refuse to inspect, assess, or remove the mattress to determine whether it is covered by the warranty if there is evidence of damage, abuse, or neglect. In such a case, Purple reserves the right to deny warranty coverage. Photos will be requested to be sent via the internet or email to Purple. Purple will require you to provide proof of your consistent use of a sufficient foundation and frame since purchase of the mattress before this warranty will apply

Warranted Defects

DO NOT REMOVE THE MATTRESS COVER IN ASSESSING THE CONDITION OF YOUR MATTRESS FOR PURPOSES OF THIS WARRANTY. THIS ACTION MAY VOID YOUR WARRANTY.

During normal, properly supported use, a warranted defect only exists if: (i) the materials of construction develop a visible indentation in the mattress greater than one (1.00) inch compared to the surrounding mattress areas after full recovery from load, or (ii) if the materials of the mattress crack, split, or otherwise fail during normal use and normal handling which is in accordance with Purple’s care and use instructions for the mattress (available at purple.com). The indentation must be of large enough width and length to be considered a body impression, and only applies to the mattress and not to settling of the cover fiber-fill materials.

Localized firmness changes are normal and are not covered under warranty. Comfort preferences are not covered under warranty. The mattress must be always covered in use, or the warranty is void (UV light degrades cushioning materials). Variations in mattress dimensions are to be normal and not covered under warranty unless greater than 2 inches.

Damage, Abuse, Neglect

It shall be reasonable to determine that the mattress has been damaged, abused, or neglected if the following are present, without limitation: tears, stains, odors, unsanitary conditions, folds, footprints, burns, cuts, or signs of jumping on the bed, rodents, insect damage or other infestation, damage from liquids or gels or blood or bodily fluids or other fluids, or damage from weather or sun exposure.

Purple highly recommends the use of a very stretchy, breathable mattress protector because without such protection your mattress may not be clean enough or undamaged enough to have this warranty apply.

Subsection 1: Frame/Foundation Requirements

  • A proper bed frame must provide sturdy support for the mattress, users, and foundation, include a center support, and have at least 5-6 legs for Queen, King and Cal King, and 4 legs for Twin and Full mattresses.
  • For Queen, King, and Cal King slatted-style bed frames, it is incumbent upon purchaser to ensure that the frame utilized offers ample structural support to the mattress. If using a slatted bed frame with no additional foundation, slats must be no more than 3.5 inches apart. Purple branded bed frames are approved.
  • Adjustable base tested to 750 lbs weight capacity. Must use 2 TXL adjustable bases with King sizes of Rejuvenate, Rejuvenate Plus and Rejuvenate Premier. Purple branded adjustable bases are approved.
  • Flat foundation must be firm, flat non-spring construction. Must be placed on a bed frame. Can NOT be used directly on the floor. If constructed with slats, must be no more than 3.5 inches apart. Purple branded flat foundations are approved.

Pillows

Congratulations on your purchase of a Purple pillow. Purple is committed to providing superior product durability and quality so that you may achieve healthful, comfortable rest. If your Purple pillow was sold new in the USA by Purple or a Purple-authorized reseller, and is defective due to faulty workmanship or materials, Purple warrants that, at Purple’s option, it will replace or repair your pillow. This non-transferable warranty is for the original purchaser only and is expressly limited as described herein. Purple undertakes no other responsibility and all other warranties, either express or implied including specifically the implied warranty of fitness for a particular purpose and the implied warranty of merchantability, are hereby waived and disclaimed.

This limited warranty extends for 1 year from the original purchase date of the original product purchased. This warranty is valid only if the purchaser is an individual who thereafter uses the product for personal consumer use. The warranty no longer applies after any resale of the pillow whether new or used. Original proof of purchase (including date) by the original purchaser, this warranty document, and the law tag from the pillow will be required to make a warranty claim. For warranty service, you are required to preserve these documents during the 1-year warranty period. This warranty applies to the pillow, and the pillow cover, and not to any other accessories or products associated with the pillow. This warranty is applicable only to pillows in normal in-home consumer use.

During normal, proper use, this warranty shall apply only if the materials of the pillow crack, split, or otherwise fail during normal use and normal handling which is in accordance with Purple’s care and use instructions for the pillow (available at https://purple.com). This warranty shall not apply if Purple determines in its reasonable discretion that the pillow has been damaged, abused, or neglected; it shall be reasonable without limitation to make such determination if the following are present: Tears, punctures, stains, odors, unsanitary conditions, folds, footprints, burns, cuts, rodents, insect damage or other infestation, damage from liquids or gels or blood or bodily fluids or other fluids, or damage from weather or sun exposure. Please note that a non-stretchy or non-breathable pillowcase will negate much of the benefit of The Purple® Pillow. For the health and safety of anyone who would be required to dispose of, or otherwise handle, the sleep set, Purple and its retailers or agents may refuse to inspect such products to assess whether covered by the warranty, in which case, Purple reserves the right to deny warranty coverage. Photos may be requested to be sent via internet to Purple. Localized firmness changes are normal and are not covered under warranty. Comfort preferences are not covered under warranty. The pillow must be always covered in use or the warranty is void (UV light degrades cushioning materials).

Bedding

Congratulations on your purchase of Purple sheets. Purple is committed to providing superior product quality so that you may achieve healthful, comfortable rest. If The purple sheets were sold new in the USA by Purple or a Purple-authorized reseller, and are defective due to faulty workmanship or materials, Purple warrants that, at Purple’s option, it will replace or repair The Purple™ Sheets. This non-transferable warranty is for the original purchaser only and is expressly limited as described herein. Purple undertakes no other responsibility and all other warranties, either express or implied including specifically the implied warranty of fitness for a particular purpose and the implied warranty of merchantability, are hereby waived and disclaimed.

This limited warranty extends for 1 year from the original purchase date of the original product purchased. This warranty is valid only if the purchaser is an individual who thereafter uses the product for personal consumer use. The warranty no longer applies after any resale of the sheets whether new or used. Original proof of purchase (including date) by the original purchaser, and this warranty document will be required to make a warranty claim. For warranty service, you are required to preserve these documents during the 1-year warranty period. This warranty applies to the sheets set, including 1 fitted sheet, 1 flat sheet, and one or two pillowcases for TXL and Queen/King sets respectively, and not to any accessories or other products associated with the sheets. Purple may respond to warranty claims by repairing or replacing one piece of a sheet set, rather than a whole sheet set at its discretion. This warranty is applicable only to the sheets in normal in-home consumer use.

This warranty shall not apply if Purple determines in its reasonable discretion that the sheets have been damaged, abused, or neglected; it shall be reasonable without limitation to make such determination if the following are present: Stains, odors, unsanitary conditions, footprints, burns, cuts, tears, signs of jumping on the bed, rodents, insect damage or other infestation, damage from liquids or gels or blood or bodily fluids or other fluids, or damage from weather or sun exposure. This warranty does not cover normal wear and tear from washing and intended use. Please note that non-stretchy tight sheets will negate much of the benefit of The Purple® Bed. For the health and safety of anyone who would be required to dispose of, or otherwise handle, the sleep set, Purple and its retailers or agents may refuse to inspect such products to assess whether covered by the warranty, in which case, Purple reserves the right to deny warranty coverage. Photos may be requested to be sent by internet to Purple. Comfort preferences are not covered under warranty.

Purple will not charge purchaser to repair or replace a piece or the whole set of a purchaser’s Purple sheets if it is reasonably deemed by Purple to be defective according to the terms herein during the first (1) year since the original purchase. Any to-or-from transportation handling and costs and inspection costs associated with repairs or replacements are the responsibility of purchaser. The warranty for any repaired or replaced sheets runs from the date of original purchase and not from the date of the replacement. Whether to repair or to replace the sheets shall be at Purple’s sole option.

Warranty Coverage Additional Limitations

If replacement of a sheet set or any piece takes place, the product being replaced must be sent to Purple or otherwise disposed of as directed by Purple. This warranty does not apply to any other accessories or products associated with the mattress protector. This warranty is applicable only to the mattress protector in normal in-home consumer use.

During normal, proper use, this warranty shall apply only if (i) there are demonstrable defects in material or workmanship, (ii) if the materials of the mattress protector crack, split, or otherwise fail during normal use and normal handling, or (iii) if the mattress protector fails to protect the user’s mattress from liquids as claimed by Purple.

Purple Mattress Protectors are covered by warranty only if they are used on a mattress that is less than 13” deep, as prescribed, and is properly stretched over the mattress so as to cover the mattress entirely without straining the product; otherwise the warranty is void. This warranty shall not apply if Purple determines in its reasonable discretion that the mattress protector has been damaged, abused, or neglected; it shall be reasonable without limitation to make such determination if the following are present: tears, unsanitary conditions, footprints, burns, cuts, or signs of jumping on the bed, rodents, insect damage or other infestation, or damage from weather or sun exposure. The warranty also does not apply to damage caused by normal wear and tear, moving, storage, natural disasters, Acts of God, inks, cosmetics, bleach, grease, nail polish, alcohol, dyes, chemical hair treatments, tanning related chemicals, solvents, molds, mildews, stains or odors of unknown origins. For the health and safety of anyone who would be required to dispose of, or otherwise handle the sleep set, Purple and its retailers or agents may refuse to inspect such products to assess whether covered by the warranty, in which case, Purple reserves the right to deny warranty coverage. WARRANTIED DEFECTS

Purple warrants this new product to be free from defects in material and workmanship (i.e., manufacturing defects only) under normal and proper use and care for a period of one (1) year.

VALIDITY OF WARRANTY

This warranty extends from the original purchase date of the original product purchased. The warranty no longer applies after any resale or transfer of the duvet whether new or used. Original proof of purchase (including date) by the original purchaser and this warranty document may be required to make a warranty claim. This warranty applies to the duvet only, and not to any other Purple product.

EXCLUSIONS

Exclusions from warranty consideration include as representative examples but are not limited to: normal wear and tear; abuse, misuse and/or non-standard use; act of nature; lack of proper care and/or maintenance; unauthorized repair, modification; rolled, compressed, or vacuum packed duvets (they should be lightly folded and not stacked). The user is expected to follow all operating and use instructions available in the product materials and online at purple.com and make periodic checks and inspection to ensure the physical condition and performance of the duvet. Warranty coverage is determined by Purple in its sole discretion after inspection of the duvet and may be refused.

This warranty is void if Purple determines in its reasonable discretion that the duvet has been damaged, abused, or neglected; it shall be reasonable to make such determination if the following are present, as representative examples without limitation: tears; stains; odors; unsanitary conditions; burns; cuts; animal damage; damage from liquids; gels; hair products and/or dyes; soaps; blood or bodily fluids or other fluids; or damage from weather or sun exposure.

DUVET REPLACEMENT

This limited warranty provides only for a repair to the existing duvet or a complete replacement of the duvet. Purple will not charge purchaser to repair or replace the product if it is reasonably deemed by Purple to be defective according to the terms herein during the first one (1) year of the original purchase date. Products replaced due to warranty issues will not be eligible for model upgrades or downgrades. The replacement will be the same as the original product purchased, if such product still exists, or a comparable replacement in the sole discretion of Purple.

Any to-or-from transportation handling and costs and inspection costs associated with repairs or replacements are the responsibility of purchaser. The warranty for any repaired or replaced duvet runs from the date of original purchase and not from the date of the replacement. Whether to repair or to replace the duvet shall be at Purple’s sole option.

Purple undertakes no other responsibility and all other warranties, either express or implied including specifically the implied warranty of fitness for a particular purpose and the implied warranty of merchantability, are hereby waived and disclaimed.

This warranty is a limited 5 year warranty, starting from the original purchase date of the original product purchased. This warranty is valid only if the purchaser is an individual who thereafter uses the product for personal consumer use. The warranty no longer applies after any resale of the Purple Bed Frame whether new or used. Original proof of purchase (including date) by the original purchaser and this warranty document will be required to make a warranty claim. For warranty service, you are required to preserve these documents during the limited warranty period. This warranty applies only to the Purple Foundation, Purple Headboard, and their included accessories. This warranty is applicable only to the Purple Bed Frame in normal in-home consumer use.

EXPRESS LIMITATIONS ON WARRANTY COVERAGE

If replacement of a Purple Bed Frame takes place, the product being replaced must be sent to Purple or otherwise disposed of in a reasonable manner. PURPLE SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF ANY BREACH OF THIS WARRANTY OR RESULTING FROM THE USE OF ANY MATTRESS, COVER, FOUNDATION, FRAME, PILLOW, TOP-OF-BED PRODUCT (SUCH AS COMFORTERS, SHEETS, MATTRESS PROTECTORS, OR BLANKETS) OR ACCESSORY. REPLACEMENT OR REPAIR AS SET FORTH HEREIN SHALL BE THE EXCLUSIVE REMEDY FOR BREACH OF THIS WARRANTY. ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION FITNESS FOR A PARTICULAR PURPOSE AND IMPLIED WARRANTIES OF MERCHANTABILITY ARE LIMITED TO THE SAME DURATION OF THIS WRITTEN WARRANTY. The Purple Bed Frame is covered by warranty only if used on a firm, flat, solid surface from the date of delivery onward to the date of the warranty claim without interruption; otherwise the warranty is void. Other placement (whether long or short term) of the Purple Bed Frame, including but not limited to environments with greater than 50% humidity or frequent exposure to moisture, voids this warranty. This warranty shall not apply if it is determined that the Purple Bed Frame has been damaged, abused, or neglected; such determination shall be reasonably made if the following are present: unsanitary conditions, rust, damage from weather or sun exposure, misconfiguration, dents, evidence of undistributed weight, or evidence of weight loads exceeding 3,000 lbs of distributed weight. For the health and safety of anyone who would be required to dispose of or otherwise handle the sleep set, Purple and its retailers or agents may refuse to inspect such products to assess whether covered by the warranty, in which case, Purple reserves the right to deny warranty coverage. Congratulations on the purchase of a Platform Base. Purple is committed to providing superior product durability and quality so that you may achieve healthful, comfortable rest. If a Platform base was sold new in the USA by Purple or a Purple-authorized reseller, and is defective due to faulty workmanship or materials, Purple warrants that, at Purple’s option, it will replace or repair the platform base. This non-transferable warranty is for the original purchaser only and is expressly limited as described herein. Purple undertakes no other responsibility and all other warranties, either express or implied including specifically the implied warranty of fitness for a particular purpose and the implied warranty of merchantability, are hereby waived and disclaimed.

This warranty is a limited 1 year warranty, starting from the original purchase date of the original product purchased. This warranty is valid only if the purchaser is an individual who thereafter uses the product for personal consumer use. The warranty no longer applies after any resale of the platform base whether new or used. Original proof of purchase (including date) by the original purchaser and this warranty document will be required to make a warranty claim. For warranty service, you are required to preserve these documents during the limited warranty period. This warranty applies to the platform base and included headboard brackets and not to any accessories or other products associated with the platform base. This warranty is applicable only to the platform base in normal in-home consumer use.

Some platform base models require a reinforcement kit to be added when assembled for a valid warranty. Purple has included the reinforcement kits in the packaging along with the platform base wherever that was necessary, or has notified you via email or postcard if your platform base falls into that category. You are required to submit proof that the reinforcement kit was properly installed onto the platform base prior to making any warranty claim.

During normal, proper use, this warranty shall apply only if (i) there are demonstrable defects in material or workmanship, or (ii) if the materials of the platform base crack, split, or otherwise fail during normal use and normal handling.

Purple platform bases are covered by warranty only if they are used on a firm, flat, solid-surface from the date of delivery onward to the date of the warranty claim without interruption; otherwise the warranty is void. Other placement (whether long or short term) of a platform base, including but not limited to environments with greater than 50% humidity or frequent exposure to moisture, voids this warranty. This warranty shall not apply if Purple determines in its reasonable discretion that the platform base has been damaged, abused, or neglected; it shall be reasonable without limitation to make such determination if the following are present: Unsanitary conditions, rust, damage from weather or sun exposure, misconfiguration, dents, evidence of undistributed weight, or evidence of weight loads exceeding 3,000 lbs of distributed weight. For the health and safety of anyone who would be required to dispose of, or otherwise handle the sleep set, Purple and its retailers or agents may refuse to inspect such products to assess whether covered by the warranty, in which case, Purple reserves the right to deny warranty coverage. Photos may be requested to be sent by internet to Purple. Comfort preferences are not covered under warranty.

Purple will not charge purchaser to repair or replace purchaser’s platform base if it is reasonably deemed by Purple to be defective according to the terms herein during the of the original purchaser. 2-Year Hassle Free Warranty

Your adjustable base is warranted by the manufacturer against defects in materials or workmanship for a period of two years from the date of purchase to the original Purchaser. During such time, the manufacturer will repair or replace, at no cost to the original Purchaser, any warranted part(s)* found to be defective by the manufacturer, in its sole discretion. This includes all pre-authorized labor and transportation costs incurred with the repair or replacement of any part found to be defective.

5-Year Warranty on Parts

During year 3 through 5 from the original purchase date, the manufacturer will replace any part on the adjustable base found to be defective by the manufacturer, to the original Purchaser. The manufacturer’s liability is limited to the replacement of the defective electrical/mechanical part(s)* ONLY with the Purchaser responsible for all service, installation, and transportation cost of said part(s).

10-Year Limited Warranty

Not withstanding the above, the manufacturer extends a 10-year warranty on mechanical base parts found to be defective on a limited basis as defined herein. Specifically, the manufacturer warrants that for a full 10 years from the commencement date of this warranty, any defect in the workmanship or the materials used shall be covered. For purposes of this 10-year warranty, it specifically excludes the cover, shroud, platform, legs, actuator lift motors, massage motors, control box, remote controls, power supply, and all power supply cords. The purchaser shall pay 1/5 of the current MSRP of the replacement part, or the entire adjustable base if deemed irreparable at the sole discretion of the manufacturer, multiplied by the number of years after the fifth year from the original purchase date. The manufacturer’s liability shall be limited to the replacement of the defective part(s) ONLY with the purchaser responsible for all service, installation and freight costs for said part. This warranty does not apply to floor models.

2-Year Floor Model Warranty

Your adjustable base floor model is warranted against defects in the electronics for a period of two years from the date of purchase to the original Purchaser. During the first two years the manufacturer will replace at no cost to the original Purchaser, any defective electronic part(s). The manufacturer’s liability is limited to the replacement for the defective electronic part(s) ONLY with the Purchaser responsible for all service, installation and transportation cost of said part(s).

This warranty does not include reimbursement/replacement for inconvenience, removal, part(s) installation, bed set up, loss of use, normal wear and tear, shipping or any other costs or expenses not expressly covered in this warranty.   • This warranty requires notice to be given to Ergomotion of any claim for repairs or replacement parts.
  • Damage to foam shroud by improper handling or misuse.

Weight Limits

This product is not rated to support weights exceeding 750 pounds (340 kg). This product is not rated to support weights in excess of 750 pounds (340 kg) inclusive of the mattress and bedding. The base will structurally support this weight, provided it is evenly distributed across the bed base. The adjustable base is not designed to support or lift this amount in the head or foot sections alone. Exceeding this weight restriction could damage the bed and/or cause injury and will void the warranty.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE MANUFACTURER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, CONSEQUENTIAL, LIQUIDATED OR SIMILAR DAMAGES, WHETHER OR NOT FORESEEABLE. 

 

Note: The exclusion directly above is inapplicable to consumers residing in Québec. To the extent permitted by law, this warranty is not transferable and will automatically terminate if the original Purchaser sells or otherwise disposes of the adjustable base. This warranty gives the Purchaser specific legal rights. Other rights, which vary from jurisdiction to jurisdiction, may exist. In addition, some jurisdictions do not allow (i) the exclusion of certain warranties, (ii) limitations on how long an implied warranty lasts and/or (iii) the exclusion or limitation of certain types of costs and/or damages, so the above limitations may not apply. 

This warranty is only valid in The United States, Canada and Puerto Rico. For all other jurisdictions, this Limited Product Warranty is valid only in the jurisdictions where the Products are sold by an Ergomotion authorized reseller or agent and is valid to the extent permitted by the applicable laws of such jurisdictions. 

 

Weight Limits 

This product is not rated to support weights exceeding 750 pounds (340kg). This product is not rated to support weights in excess of 750 pounds inclusive of the mattress and bedding. The base will structurally support this weight, provided it is evenly distributed across the bed base. The adjustable base is not designed to support or lift this amount in the head or foot sections alone. Exceeding this weight restriction could damage the bed and/or cause injury and will void the warranty.

Damaged or Lost Purchases

We strive to ensure that all purchases arrive safely and in excellent condition. However, if an item is damaged or lost during the delivery process, we require the following steps to be taken to resolve the issue:
1. Reporting Timeline: Any claims regarding damaged or lost items during delivery must be reported to our customer service team within 30 days from the date of delivery.
2. Required Documentation: To process a claim for damaged or lost goods, please provide the following information:
o Order number and proof of purchase.
o A detailed description of the damage or confirmation that the package was not received.
o If applicable, photos of the damaged item and its packaging.
3. Resolution Process: Upon receiving the claim, we will investigate the issue and take appropriate action, which may include:
o Offering a replacement for the damaged or lost item.
o Issuing a refund.
o Coordinating with the delivery service to locate the lost item or confirm the damage.
4. Exclusions: Any claims submitted after the 30-day window may not be eligible for a refund or replacement.
